On September 13th, the Biden Administration said it will use executive authority to stop the abuse of the de minimis exemption, which many online Chinese exporters, such as Temu and Shein, have exploited to gain unfair shipping advantages over U.S. online retailers.
The Administration also called on Congress to pass legislation this year to reform the de minimis exemption comprehensively to further protect American consumers, workers, and businesses.
Notably, the Administration said it will issue a Notice of Proposed Rulemaking that would exclude from the de minimis exemption all shipments containing products covered by tariffs imposed under Sections 201 or 301 of the Trade Act of 1974, or Section 232 of the Trade Expansion Act of 1962.
For more information, we urge you to review this report as well as the announcement from the Administration.
The ACMA, which has had this matter on our radar as a key issue for our members since earlier this year, will continue to monitor it closely. We may call on members or others in key districts for help and support, and will keep you posted of further developments.
